Latest video insight talks Bail – what does someone being on Bail actually mean?
In the third video released by My CWA designed to help victims, professionals and anyone interested in understanding how the charity strives to help victims of Domestic Abuse, the team at the Cheshire East charity, formerly known as Cheshire Without Abuse, shares its third insight resource.
In the 5 minute interview, Vicky Sail, ops manager at My CWA talks with DI Claire Jesson from Crewe Police about the meaning of Bail and the options that Police have in relation to using this area of law as a mechanism.
Bail means that someone will be called to attend at a station or even to court. If a person is charged with a criminal offence, the police must release them on bail unless:
The police are concerned about the identity or address of the accused
The offender poses a risk to themselves or others
The police believe that the offender poses a flight risk, will not turn up to court or that they will attempt to interfere with the administration of justice.
In the majority of cases, a ‘presumption of bail' will be in place. This means that the accused will be given bail unless the prosecutor can prove that there are significant reasons for bail to be withheld. This is the case even for serious crimes, or when the accused has been in trouble with the police several times before.
This can feel frightening for some victims, if they feel their perpetrator is released on Bail, DI Jesson discusses with Vicky the safeguarding measures that Bail can offer, including reassurance for victims who’s perpetrator may have faced bail conditions.
